Farmingville, NY - In response to the challenges of the coronavirus pandemic, the Town of Brookhaven office of the Assessor has announced a modification to the Tax Grievance procedure. Since Town Hall is closed to the public, the tentative assessment roll will only be available for inspection on the Town of Brookhaven website at www.BrookhavenNY.gov, not on a paper copy in the Assessor’s office. Filing of the tentative assessment roll will occur on June 1, 2020 rather than the traditional filing date of May 1. On June 1, 2020, the electronic and printable grievance forms will be accessible on the website and the Assessor will start accepting grievances. Electronic grievances can be filed through the website and paper grievances can be dropped off in the Town Hall lobby or mailed with a postmark no later than June 23, 2020. The Town of Brookhaven is reaching out to the larger attorney and representative firms to establish a method for receiving grievance application data electronically. Tax Grievance Day is scheduled for June 23, 2020. It will be conducted via Zoom Video Conferencing, which the Town has been using for Town Board, Planning Board and Board of Zoning Appeals meetings and public hearings and more.
The Board of Assessment Review will adjudicate the grievances throughout the month of July and the final assessment roll will be certified no later than August 1, 2020. Those who intend to challenge the board’s decision, may file an appeal with the New York State Supreme Court within 30 days of final roll certification. Those with grievances for owner-occupied residential property may file a small claims assessment review proceeding. All others must file a Real Property Tax (RPT) Law Article 7 proceeding which is also known as a Certiorari proceeding.
